1. Introducción:

Ballers Puerto Rico Sportsbook, LLC proporciona y opera un sitio web de apuestas deportivas en ballerspr.com, ballerssportsbook.com, ballersapuestas.com y a través de una aplicación móvil relacionada. Nos complace ofrecerle acceso a nuestro sitio web y la capacidad de participar en apuestas deportivas en línea mientras se encuentra en Puerto Rico, así como al contenido, productos, servicios y promociones que podemos proporcionar desde nuestro sitio web. El acceso a los servicios está sujeto a los siguientes Términos y Condiciones, nuestra política de privacidad y las Reglas Oficiales y Reglamentos para las apuestas y promociones aplicables.

1. Aceptación de los Términos y Condiciones

LEA DETENIDAMENTE ESTOS TÉRMINOS DE USO ANTES DE UTILIZAR BALLERS SPORTSBOOK, YA QUE CONTIENEN INFORMACIÓN IMPORTANTE Y AFECTAN SUS DERECHOS LEGALES Y OBLIGACIONES. SE LE PEDIRÁ QUE ACEPTE LOS TÉRMINOS DE USO Y SI NO ESTÁ DE ACUERDO CON LOS TÉRMINOS, ENTONCES NO PODRÁ ACCEDER A NUESTROS SERVICIOS.

1. Definiciones:

Ballers Sportsbook: (También "Nosotros" o "Ballers"). Una Sociedad de Responsabilidad Limitada, constituida bajo las leyes de Puerto Rico y con licencia como Operador de Apuestas Deportivas por la Comisión de Juegos del Gobierno de Puerto Rico, para aceptar y pagar Apuestas Deportivas.

Apuestas Deportivas: El negocio de aceptar apuestas en efectivo o su equivalente en eventos deportivos, partes de un evento deportivo, eventos especiales o en el desempeño individual de las personas que participan en un Evento Deportivo o Evento Especial, o una combinación de estos.

Sitio Web: Es la plataforma digital que Ballers pone a disposición a través de Internet y que alberga y facilita diversas formas de actividades de apuestas deportivas para los usuarios registrados mientras estos se encuentran en Puerto Rico. Además, el sitio web ofrece una Interfaz de Usuario que incluye preinscripción, selección de eventos, seguridad, sitio web de pagos, historial de apuestas, reglas y soporte al cliente. En la medida en que ofrezcamos estadísticas 'en vivo' durante el juego, todas las estadísticas 'en vivo' y otra información proporcionada a través del Sitio Web de Ballers y fuentes de información relacionadas son no oficiales. Las estadísticas deportivas en vivo y sus respectivos componentes se ofrecen únicamente con fines informativos y/o de entretenimiento y no se utilizan para determinar los resultados de nuestros eventos. Si bien Ballers y los terceros utilizados para proporcionar nuestros servicios hacen esfuerzos razonables para incluir información precisa y actualizada, ni Ballers ni sus proveedores de terceros garantizan ni hacen representaciones de ningún tipo con respecto a la información proporcionada a través del Sitio Web y fuentes de información relacionadas. Ballers y sus proveedores de terceros no serán responsables ni estarán obligados por la precisión, utilidad o disponibilidad de ninguna información transmitida o puesta a disposición a través del Sitio Web de Ballers y fuentes de información relacionadas, ni serán responsables por ningún error u omisión en dicha información.

Usuario, Jugador: Una persona que ha registrado una cuenta con Ballers y participa en actividades disponibles en la plataforma, como ver probabilidades, realizar apuestas, depositar y retirar fondos, y participar en actividades promocionales. Los usuarios aceptan cumplir con los términos y condiciones de la Plataforma de Ballers, así como cualquier otra regla, regulación o política establecida por la plataforma o el Gobierno de Puerto Rico.

Servicio/Solución/Plataforma: Los servicios proporcionados por Ballers a los usuarios a través del sitio web. Los componentes del sitio web que el usuario utilizará para registrarse, jugar y realizar transacciones.

Contenido: El contenido se refiere a todos los tipos de información, datos, materiales y elementos visuales presentes en el sitio web de Ballers. Esto puede incluir: opciones de apuestas. Contenido textual de publicaciones de blog, noticias, artículos, guías, consejos, preguntas frecuentes y términos y condiciones. Contenido generado por el usuario producido por los propios usuarios, como comentarios, reseñas, discusiones, etc. Gráficos y medios. Características interactivas. Contenido promocional, como anuncios, ofertas de bonificación, campañas promocionales, programas de fidelización y cualquier otro material de marketing. Contenido legal y regulatorio, como políticas de privacidad, términos y condiciones, pautas de juego responsable, información de licencia y otros avisos legales y comunicación, incluyendo boletines informativos, correos electrónicos, notificaciones y otras formas de comunicación generadas por el sitio web.

Eventos: por lo general se refieren a un juego o partido deportivo específico en el que se pueden realizar apuestas. A través del sitio web de Ballers, los usuarios tendrán acceso a los siguientes eventos:

• Evento Individual: Este es un solo juego o partido, como un partido de fútbol entre el Equipo A y el Equipo B.

• Evento de Torneo: Esto se refiere a un torneo o competencia completa. Por ejemplo, en el caso de la Copa Mundial de la FIFA, el "evento" podría ser todo el torneo, y se podrían realizar apuestas sobre el ganador general.

• Evento Proposicional (Prop): En algunos casos, un evento podría referirse a una ocurrencia específica dentro de un juego, como si un jugador en particular marcará un gol o el número de tiros de esquina en un partido de fútbol. Estas se conocen como apuestas de proposición.

• Evento en Vivo o en Juego: Los eventos en juego se refieren a partidos o juegos que están en curso en ese momento. Algunas plataformas de apuestas deportivas ofrecen apuestas en vivo, donde los apostadores pueden realizar apuestas sobre diversos resultados mientras el evento está en curso.

• Evento Futuro: Esto se refiere a un evento que ocurrirá en el futuro. Los apostadores pueden realizar apuestas sobre los resultados de estos eventos futuros, como quién ganará el próximo Super Bowl o la Premier League.

Probabilidades: la probabilidad de que ocurra un evento o resultado particular. Las probabilidades se utilizan para calcular el pago de una apuesta ganadora y reflejan la probabilidad percibida de un evento o resultado particular. Las probabilidades pueden cambiar antes de un partido o juego en función de varios factores, como lesiones, clima y la cantidad de dinero apostado en cada lado, etc.

Apuestas: Son apuestas o apuestas realizadas en un resultado o conjunto de resultados durante un evento deportivo. Los tipos comunes de apuestas ofrecidas por Ballers incluyen (las apuestas se definen con mayor detalle en las reglas de apuestas): apuestas de spread, apuestas de dinero, apuestas totales (más/menos), combinadas, apuestas de proposición, apuestas de teaser, apuestas de teaser inverso, apuestas de round robin, apuestas futuras, apuestas de cabeza a cabeza, apuestas de si. Una apuesta puede estar abierta, lo que significa que el resultado del evento aún no se ha decidido, o resuelta, lo que significa que el resultado del evento se ha decidido.

Ganancias: la cantidad de dinero que un apostador recibe de una apuesta exitosa, además de la apuesta original. Esto se determina por las probabilidades que se dieron para la apuesta en el momento en que se realizó. Las ganancias pueden estar sujetas a impuestos u otras deducciones. Los jugadores generalmente pueden retirar las ganancias una vez que una apuesta se ha resuelto. Para obtener más detalles, consulte las secciones de pagos, depósitos y retiros de estos términos y condiciones.

Cuenta del Jugador: Una cuenta registrada que un usuario (apostador) crea con Ballers Sportsbook y que es verificada y aprobada por Ballers. La cuenta es personal para el usuario y contiene su información personal, historial de apuestas, historial de transacciones y saldo actual. La cuenta de Ballers permite al usuario personalizar ciertos aspectos de su cuenta, como preferencias de comunicación, límites de depósito y controles de juego responsable.

1. Registro:

Para establecer una cuenta, se le pedirá que proporcione cierta información a Ballers Sportsbook, que incluye: Nombre completo, entiéndase nombre y apellidos, Género, Fecha de nacimiento, Nacionalidad, Número de licencia de conducir o pasaporte, Correo electrónico y Dirección. También se le pedirá que cree un Nombre de usuario y una Contraseña y complete ciertas declaraciones. Una vez que haya completado este primer paso, deberá visitar una de las localidades autorizadas de Ballers y presentar una identificación válida a un empleado, este verificará y validará la información que proporcionó y aprobará o denegará su cuenta.

1. Elegibilidad:

Debe tener al menos dieciocho (18) años de edad para abrir una cuenta con Ballers Sportsbook ("Cuenta"). También debe estar físicamente ubicado en el Commonwealth de Puerto Rico para abrir la cuenta y participar en cualquier juego en línea y para realizar una apuesta o ganar premios ofrecidos por el sitio web. Usted acepta que Ballers Sportsbook confirme su edad e identidad.

Puede establecer solo una (1) Cuenta por persona para participar en los Servicios ofrecidos en el sitio web. En caso de que Ballers descubra que ha abierto más de una Cuenta por persona, además de cualquier otro derecho que pueda tener Ballers, Ballers se reserva el derecho de suspender o cancelar cualquiera o todas sus Cuentas y cancelar, retener o revocar la adjudicación de cualquier ganancia o premio. Usted es responsable de mantener la confidencialidad de sus nombres de inicio de sesión y contraseñas y acepta la responsabilidad de todas las actividades, cargos y daños que ocurran en su Cuenta. El método para cambiar o recuperar su contraseña se encuentra en la sección de preguntas frecuentes del sitio web. Puede elegir la fortaleza de su autenticación siguiendo el proceso ubicado en la pestaña "Gestión de cuentas y juego responsable" del sitio web.

Será una violación de estos Términos de Uso permitir que cualquier otra persona use su Cuenta para participar en cualquier Juego. Si tiene motivos para creer que alguien está utilizando su Cuenta sin su permiso, debe contactarnos de inmediato. No seremos responsables de ninguna pérdida o daño que resulte de su falta de notificación de uso no autorizado. Si solicitamos información de registro, debe proporcionarnos información precisa y completa y actualizar la información cuando cambie.

Existen ciertas prohibiciones y restricciones federales con respecto a los juegos en Internet (es decir, 18 U.S.C. §§ 1084 y ss. (Ley Wire) y 31 U.S.C. §§ 5361 a 5367 (Ley de Ejecución de Juegos de Azar en Internet)). Es un delito federal para las personas físicamente ubicadas fuera de Puerto Rico participar en apuestas por Internet a través de un operador de Puerto Rico. La disponibilidad de nuestros Servicios no constituye una oferta, solicitud o invitación por nuestra parte para utilizar nuestros Servicios fuera del Commonwealth de Puerto Rico. Ballers no será responsable por ninguna violación de leyes locales, nacionales, federales, estatales u otras que puedan ocurrir como resultado de su uso de los Servicios.

Su cuenta se considerará 'Inactiva' si no ha iniciado sesión durante un período de XX años. Si su cuenta se considera 'Inactiva', Ballers cerrará la cuenta y cualquier saldo restante se considerará abandonado y se remitirá.

"Titular de Cuenta Autorizado" se define como la persona natural de dieciocho (18) años de edad o más a la que se le asigna una dirección de correo electrónico por parte de un proveedor de acceso a Internet, proveedor de servicios en línea u otra organización (por ejemplo, empresa, institución educativa, etc.) que es responsable de asignar direcciones de correo electrónico para el dominio asociado con la dirección de correo electrónico proporcionada para el registro en el sitio web. Al ingresar un método de pago para participar en los Juegos, el Titular de Cuenta Autorizado afirma por la presente que es el propietario legítimo de la cuenta del método de pago utilizada para realizar cualquier depósito en el sitio web. Será una violación de estos Términos de Uso que cualquier Titular de Cuenta Autorizado envíe un pago utilizando cualquier método de pago que no sea propiedad del Titular de Cuenta Autorizado.

En caso de que se le devuelvan cargos de sus depósitos, cualquier ganancia, recompensa, créditos y/o otros bonos u ofertas promocionales generados en relación con el depósito devuelto serán invalidados y perdidos por usted, y se deducirán de su saldo de cuenta. En el caso de que cualquier depósito realizado por usted sea cancelado o no se autorice por cualquier motivo, incluyendo, sin limitación, un contracargo o que no sea honrado por su institución financiera, usted acepta renunciar a dicho depósito, y Ballers Sportsbook puede y se reserva el derecho a: (i) invalidar y/o deducir el monto del depósito de su Cuenta; (ii) cobrarle un cargo de servicio o debitar dicho cargo de servicio de su Cuenta; (iii) suspender y/o cerrar su Cuenta; y/o (iv) recuperar los fondos utilizando cualquier otro medio apropiado, incluyendo, sin limitación, la utilización de una agencia de cobranza (con la que Ballers necesitará compartir su información personal), lo que puede tener un impacto perjudicial en su calificación crediticia. Usted es responsable y acepta reembolsar a Ballers por cualquier y todas las reclamaciones, tarifas, multas, penalizaciones, costos y gastos relacionados con cualquier depósito cancelado o con contracargos, incluyendo, sin limitación, cualquier tarifa o gasto relacionado con una agencia de cobranza contratada por Ballers.

Los empleados de Ballers ("Empleados") y los Miembros de la Familia Inmediata de los Empleados (un "Miembro de la Familia Inmediata" significa cualquier pareja doméstica o pariente que resida en la misma residencia, incluyendo, sin limitación, padres, abuelos, suegros, hijos, hermanos y cónyuges) no tienen permitido registrarse o utilizar los Servicios.

Otros Participantes Prohibidos. Cualquier individuo cuya participación pueda socavar la integridad de las apuestas o del evento deportivo o por otra buena causa, incluyendo pero no limitado a: (i) cualquier individuo que realice una apuesta como agente o representante; (ii) cualquier persona que sea atleta, entrenador, árbitro, jugador o miembro del personal de árbitros, en o en cualquier evento deportivo supervisado por el organismo rector deportivo de esa persona; (iii) una persona que ocupe un cargo de autoridad o influencia suficiente para ejercer influencia sobre los participantes en una competencia deportiva, incluyendo pero no limitado a entrenadores, gerentes, entrenadores, preparadores físicos y proveedores médicos (iv) una persona con acceso a ciertos tipos de información exclusiva sobre cualquier evento deportivo supervisado por el organismo rector deportivo de esa persona, o (v) una persona identificada por cualquiera de las listas de exclusión proporcionadas por la Comisión de Juegos, no tendrá permitido apostar en ningún evento.

Ballers tomará todas las medidas necesarias para asegurarse de que las apuestas solo se realicen cuando los usuarios estén físicamente presentes en Puerto Rico. No puede utilizar una VPN, proxy u otros servicios o dispositivos similares que oculten o manipulen la identificación de su ubicación real.

Además, la conducta que se consideraría impropia incluye, pero no se limita a:

• Falsificar información personal requerida para participar en un Juego o reclamar un premio;

• Involucrarse en cualquier tipo de fraude financiero, incluyendo el uso no autorizado de instrumentos de crédito para participar en un Juego o reclamar un premio;

• Conspirar con cualquier otro individuo(s) o participar en cualquier tipo de juego sindicado;

• Cualquier violación de las Reglas o los Términos de Uso;

• Utilizar una sola Cuenta para participar en un Juego en nombre de varios participantes o colaborar de alguna otra manera con otros para participar en cualquier Juego;

• Utilizar medios automatizados (incluyendo, sin limitación, bots de cosecha, robots, analizadores de datos, arañas o raspadores de pantalla) para obtener, recopilar o acceder a cualquier información en el sitio web o de cualquier Usuario para cualquier propósito.

• Cualquier tipo de abuso de bonos, abuso del programa de recomendación de amigos o abuso de cualquier otra oferta o promoción;

• Manipular la administración de un Juego o intentar de alguna manera manipular los programas informáticos o cualquier medida de seguridad asociada con un Juego;

• Obtener información de otros participantes y enviar correo no deseado a otros participantes; o

• Abusar del sitio web de cualquier manera.

Los usuarios reconocen además que la renuncia y/o devolución de cualquier premio no impedirá que Ballers emprenda acciones penales o civiles relacionadas con tal conducta.

Al ingresar a un Juego o aceptar cualquier premio, los participantes, incluyendo sin limitación al(s) ganador(es), aceptan indemnizar, liberar y eximir de responsabilidad a Ballers, sus matrices, subsidiarias, afiliadas y agentes, así como a los funcionarios, directores, empleados, accionistas y representantes de cualquiera de las entidades mencionadas anteriormente (colectivamente, las "Partes Liberadas"), sus matrices, subsidiarias, afiliadas y divisiones, y sus respectivos directores, funcionarios, empleados, agentes y representantes de cualquier reclamo o acción de cualquier tipo que pueda surgir en relación con la participación en el Juego, la recepción, propiedad, uso o mal uso de cualquier premio o mientras se prepara para, participa en y/o viaja hacia o desde cualquier actividad relacionada con el premio, así como cualquier reclamo basado en derechos de publicidad, difamación o invasión de la privacidad. Ballers puede, a su entera y absoluta discreción, requerir que un Titular de Cuenta Autorizado firme una liberación de reclamaciones separada similar a la enumerada anteriormente en este Párrafo como condición para recibir cualquier premio o pago.

Ballers no se hace responsable de: cualquier información de entrada incorrecta, inválida o inexacta; errores humanos; retrasos en el correo/correos con franqueo insuficiente; mal funcionamiento técnico; fallas, incluyendo interrupciones de servicios públicos o de telefonía; omisiones, interrupciones, eliminaciones o defectos de cualquier sistema telefónico o de red, sistemas informáticos en línea, datos, equipos informáticos, servidores, proveedores o software (incluyendo, sin limitación, software y sistemas operativos que no permiten que un participante participe en un Juego), incluyendo, sin limitación, cualquier lesión o daño a la computadora o equipo de video de cualquier participante u otra persona relacionada con la participación en un Juego; la imposibilidad de acceder al sitio web o a cualquier página web que forme parte o esté relacionada con el sitio web; robo, manipulación, destrucción o acceso no autorizado o alteración de entradas y/o imágenes de cualquier tipo; datos que se procesan tarde o incorrectamente o que están incompletos o se pierden debido a problemas telefónicos, postales, de computadoras o electrónicos o a la congestión de tráfico en líneas telefónicas o sistemas de transmisión, o en la Internet, o en las instalaciones del proveedor de servicios, o en cualquier sitio telefónico o sitio web o por cualquier otro motivo; errores tipográficos, de impresión u otros, o cualquier combinación de los mismos.

Ballers no es responsable de las entradas incompletas, ilegibles, desviadas o robadas. Si por alguna razón un juego no puede ejecutarse según lo planeado originalmente, o si un juego, aplicación informática o sitio web asociado al mismo (o alguna parte de ellos) se corrompe o no permite la entrada adecuada a un juego de acuerdo con los Términos de Uso o las Reglas aplicables, o si la infección por un virus informático (u similar), un error, manipulación, intervención no autorizada, acciones de los participantes, fraude, fallos técnicos o cualquier otra causa de cualquier tipo, en la opinión única de Ballers, corrompe o afecta la administración, seguridad, equidad, integridad o conducta adecuada de un juego, la Compañía se reserva el derecho, a su exclusiva discreción, de descalificar a cualquier individuo implicado en tal acción y/o cancelar, terminar, extender, modificar o suspender el juego, y seleccionar al(s) ganador(es) de entre todas las entradas elegibles recibidas. Si tal cancelación, terminación, modificación o suspensión ocurre, la notificación se publicará en el sitio web.

CUALQUIER INTENTO POR PARTE DE UN PARTICIPANTE U OTRA PERSONA DE DAÑAR DELIBERADAMENTE EL SITIO WEB O MINAR EL FUNCIONAMIENTO LEGÍTIMO DE CUALQUIER JUEGO CONSTITUYE UNA VIOLACIÓN DE LAS LEYES PENALES Y/O CIVILES, Y EN CASO DE TAL INTENTO, BALLERS SE RESERVA EL DERECHO DE BUSCAR DAÑOS Y OTROS REMEDIOS DE PARTE DE DICHA PERSONA EN LA MEDIDA MÁS AMPLIA PERMITIDA POR LA LEY.

Todas las entradas pasan a ser propiedad de Ballers y no serán reconocidas ni devueltas.

Para ser elegible para participar en cualquier juego o recibir cualquier premio, el titular de la cuenta autorizado puede estar obligado a proporcionar a Ballers documentación adicional y/o información para verificar la identidad del titular de la cuenta autorizado y proporcionar pruebas de que se cumplen todos los requisitos de elegibilidad. En caso de una disputa sobre la identidad o elegibilidad de un titular de cuenta autorizado, Ballers, a su exclusiva y absoluta discreción, utilizará cierta información recopilada por Ballers para ayudar a verificar la identidad y/o elegibilidad de dicho titular de cuenta autorizado.

La participación en cada juego debe realizarse únicamente según lo especificado en los Términos de Uso. El incumplimiento de estos Términos de Uso resultará en descalificación y, si corresponde, pérdida del premio.

Cuando sea legal, tanto los participantes como los ganadores consienten en el uso de su nombre, voz e imagen/fotografía en relación con el desarrollo, producción, distribución y/o explotación de cualquier juego o el sitio web. Los ganadores aceptan que, a partir de la fecha de notificación de Ballers de su condición de posibles ganadores y hasta que Ballers les informe que ya no es necesario hacerlo, se pondrán a disposición de Ballers para actividades de publicidad, publicidad y promoción.

1. Seguridad de la cuenta

En el momento de registrarse para acceder a la cuenta en línea, debe proporcionar una dirección de correo electrónico válida y suministrar un nombre de usuario y una contraseña que se utilizarán junto con su cuenta. No puede usar un nombre de usuario que promueva una empresa comercial o un nombre de usuario que Ballers, a su exclusiva discreción, considere ofensivo. Muchas partes del Servicio requieren registro para el acceso (las "Áreas Restringidas"). Usted es responsable de mantener la confidencialidad de la contraseña y es totalmente responsable de todos los usos de su nombre de usuario y contraseña, ya sea por usted o por otros. Usted acepta (a) nunca usar la misma contraseña para el Servicio que ha utilizado o utiliza fuera del Servicio; (b) mantener confidencial su nombre de usuario y contraseña y no compartirlos con nadie más; (c) notificar de inmediato a Ballers cualquier uso no autorizado de su nombre de usuario y contraseña o cuenta o cualquier otra violación de seguridad; y (d) utilizar solo su propio nombre de usuario y contraseña para acceder a las Áreas Restringidas del Servicio. Ballers no puede ni será responsable de ninguna pérdida o daño que resulte de su incumplimiento de esta Sección.

Usted reconoce y acepta que Ballers está autorizado para actuar según las instrucciones recibidas mediante el uso de su nombre de usuario y contraseña, y que Ballers puede, pero no está obligado a, negar el acceso o bloquear cualquier transacción realizada mediante el uso de su nombre de usuario y contraseña sin previo aviso si creemos que su nombre de usuario y contraseña están siendo utilizados por alguien que no sea usted, o por cualquier otra razón.

Ballers Sportsbook puede requerir que cambie su nombre de usuario o puede cambiar unilateralmente su nombre de usuario.

1. Entrada al juego, Estadísticas del juego, Resultados del juego y Premios

Entrada: Los usuarios registrados y validados podrán visitar el sitio web, iniciar sesión y ver los mercados y eventos de apuestas deportivas ofrecidos por Ballers y disponibles para realizar una apuesta. Cuando seleccione participar en un evento o eventos, seleccione la cantidad de apuesta y complete el proceso de entrada, la cantidad de dólares estadounidenses listados se debitará de su cuenta de Ballers Sportsbook.

Estadísticas: En la medida en que Ballers ofrezca estadísticas "en vivo" durante el juego, todas las estadísticas "en vivo" y otra información proporcionada a través del sitio web y fuentes de información relacionadas son no oficiales. Las estadísticas deportivas en vivo y sus respectivos componentes se ofrecen únicamente con fines informativos y/o de entretenimiento y no se utilizan para determinar los resultados de nuestros juegos. Si bien Ballers y las terceras partes utilizadas para proporcionar los Servicios de Ballers hacen esfuerzos razonables para incluir información precisa y actualizada, ni Ballers ni sus proveedores de terceros garantizan ni hacen representaciones de ningún tipo con respecto a la información proporcionada a través del sitio web de Ballers y fuentes de información relacionadas. Ballers y sus proveedores de terceros no serán responsables ni estarán obligados por la precisión, utilidad o disponibilidad de cualquier información transmitida o puesta a disposición a través del sitio web y fuentes de información relacionadas, ni serán responsables de ningún error u omisión en esa información.

Resultados: En la medida aplicable, los resultados del juego y los cálculos de premios se basan en las estadísticas finales y los resultados de puntuación al final del último juego deportivo de cada juego individual. 1. Depósitos y Retiros

Al establecer su cuenta y depositar fondos, acepta proporcionarnos una dirección de correo válida, fecha de nacimiento y número de seguro social, así como cualquier otra información que Ballers pueda requerir para realizar controles de identidad apropiados y cumplir con las normativas federales y estatales aplicables. Los depósitos en una cuenta se pueden realizar mediante los medios proporcionados en el sitio web. Ballers puede limitar la cantidad que un usuario puede depositar en su cuenta de acuerdo con los límites impuestos por el gobierno, la gestión de riesgos y la discreción de Ballers. Ballers Sportsbook acepta diversas formas de pago para realizar depósitos, tales como efectivo, tarjetas de crédito, ATH y ATH Móvil. Estos fondos le pertenecen a usted, sujeto a la revisión de pruebas de fraude, y Ballers no puede utilizar estos fondos para cubrir gastos operativos ni para ningún otro propósito. Sus retiros se realizarán desde esta cuenta bancaria separada.

Ballers se reserva el derecho de cerrar o suspender las cuentas y anular cualquier apuesta realizada por cualquier persona cuando, a juicio razonable de Ballers, la cuenta no se haya utilizado con integridad y/o la apuesta no se haya realizado de buena fe. LA EMPRESA NO GARANTIZA QUE EL SITIO WEB, CUALQUIERA DE LAS FUNCIONES DEL SITIO WEB O CUALQUIER CONTENIDO EN EL MISMO SERÁN ININTERRUMPIDOS O LIBRES DE ERRORES; QUE SE CORREGIRÁN LOS DEFECTOS; O QUE EL SITIO WEB O LOS SERVIDORES QUE LOS HACEN DISPONIBLES ESTÉN LIBRES DE VIRUS U OTROS COMPONENTES DAÑINOS.

AL ACCEDER AL SITIO WEB, USTED ENTIENDE QUE PUEDE RENUNCIAR A LOS DERECHOS CON RESPECTO A RECLAMACIONES QUE EN ESTE MOMENTO SON DESCONOCIDAS O NO SOSPECHADAS. Ballers responderá a dichas quejas por escrito en un plazo de diez días hábiles. Si la reparación solicitada no se concede en respuesta a la queja, se especificarán las razones en la respuesta.

Quejas que Requieren Información Adicional: Si la respuesta a una queja es que se necesita más información, se indicará el tipo y la naturaleza específica de la información requerida. Una vez recibida la información adicional necesaria, Ballers emitirá una nueva respuesta en un plazo de siete días.

Conservación de Quejas por parte de Ballers: Todas las quejas recibidas por Ballers de un jugador y las respuestas de Ballers a las quejas se conservarán durante al menos cinco años.

Autoridad del Jugador para Acercarse a la Comisión de Juegos de Puerto Rico: Según lo estipulado en la Regulación 9316 de Apuestas Deportivas en Puerto Rico, si un jugador no está satisfecho o de acuerdo con las opciones y/o remedios proporcionados por Ballers para resolver una reclamación o queja, puede acercarse a la Comisión de Juegos de Puerto Rico con el propósito de mediar y posiblemente llegar a una resolución sobre el asunto. 15. Varios:

Terminación: Puede cerrar su cuenta y retirar sus depósitos y/o ganancias en cualquier momento y por cualquier motivo. El cierre de la cuenta se realizará a través del departamento de servicio al cliente de Ballers y seguirá los términos descritos en esta sección. Cuentas Inactivas: Su cuenta puede considerarse 'Inactiva' si no ha iniciado sesión durante un período de 12 meses. Si su cuenta se considera 'Inactiva', Ballers cerrará la cuenta y cualquier saldo restante se considerará abandonado y se remitirá de acuerdo con las regulaciones locales. Jurisdicción: Estos Términos de Uso estarán regidos por las leyes sustantivas internas del Estado Libre Asociado de Puerto Rico, sin tener en cuenta sus principios de conflicto de leyes ni ninguna otra ley o regulación que permita o requiera la aplicación de las leyes sustantivas de cualquier jurisdicción que no sea el Estado Libre Asociado de Puerto Rico. Ballers Puerto Rico Sportsbook LLC provides and operates a sports betting website at ballerspr.com ballerssportsbook.com, ballersapuestas.com and a through a related mobile app. We are pleased to offer you access to our Website and the ability to participate in online sports betting while you are in Puerto Rico, as well as to the content, products, services, and promotions that we may provide from our Website. The access to the services is subject to the following Terms and Conditions, our privacy policy and the Official Rules and Regulations for the applicable bets and promotions.

1. Acceptance of Terms and Conditions

1. Definitions:

Ballers Sportsbook: (Also We”, “Us”, or “Ballers”). A Limited Liability Corporation, incorporated under the laws of Puerto Rico licensed as a Sports Betting Operator by the Comision de Juegos del Gobierno de Puerto Rico, to accept and pay Sports Betting.

Sports Betting: The business of accepting bets, in cash or their equivalent, on sports events, parts of a sports event. special events, or on the individual performance of individuals who participate in a Sports Event or Special Event, or a combination of these.

Website: Is the digital platform Ballers makes accessible through the internet that hosts and facilitates various forms of sports betting activities to registered users while these users are present in Puerto Rico. In addition, the website offers a Users Interface which includes pre-registration, event selection, security, payment website, bet history, rules and customer support. To the extent that we offer 'live' statistics during gameplay, all 'live' statistics and other information provided through the Ballers Website and related information sources are unofficial. Live sports statistics and their respective components are offered for informational and/or entertainment purposes only and are not used to determine the results of our the events. While Ballers and the third parties used to provide our services use reasonable efforts to include accurate and up-to-date information, neither Ballers nor its third party providers warrant or make any representations of any kind with respect to the information provided through the Website and related information sources. Ballers and its third party providers shall not be responsible or liable for the accuracy, usefulness, or availability of any information transmitted or made available via the Ballers Website and related information sources, and shall not be responsible or liable for any error or omissions in that information.

User, Player:  An individual who has registered an account with Ballers and engages in activities available on the platform such as viewing odds, placing bets, depositing and withdrawing funds, and participating in promotional activities. User agree to comply with the terms and conditions of the Ballers Platform, as well as any other rules, regulations, or policies set forth by the platform or the Puerto Rico Government. 

Service/Solution/Platform: The services provided by Ballers to users through the website. The components of the website the user will use to register, play and make transactions

Content: Content refers to all types of information, data, materials, and visual elements present on the Ballers website. This may include: Betting options. Textual content from blog posts, news, articles, guides, tips, FAQs, and terms and conditions. User-generated content produced by the users themselves, such as comments, reviews, discussions, etc. Graphics and media. Interactive features. Promotional Content such as Advertisements, bonus offers, promotional campaigns, loyalty programs, and any other marketing materials. Legal and regulatory content such as privacy policies, terms and conditions, responsible gambling guidelines, licensing information, and other legal notices and Communication content including  newsletters, emails, notifications, and other forms of communication generated by the website.

Events: typically refer to a specific sports game or match on which bets can be placed. Through the Ballers Website, users will have access to the following events

• Single Event: This is a single game or match, such as a football match between Team A and Team B.
• Tournament Event: This refers to an entire tournament or competition. For example, in the case of the FIFA World Cup, the "event" could be the entire tournament, and bets could be placed on the overall winner.
• Propositional (Prop) Event: In some cases, an event could refer to a specific occurrence within a game, like whether a particular player will score a goal, or the number of corner kicks in a football match. These are known as prop bets.
• In-Play or Live Event: In-play events refer to matches or games that are currently ongoing. Some sports betting platforms offer live betting, where bettors can place bets on various outcomes while the event is in progress.
• Future Event: This refers to an event that will happen in the future. Bettors can place bets on the outcomes of these future events, such as who will win the next Super Bowl or Premier League.

Odds: the likelihood of a particular event or outcome happening. Odds are used to calculate the payout from a winning bet and reflect the perceived probability of a particular event or outcome. Odds can change leading up to a match or game based on various factors, such as injuries, weather, and the amount of money bet on each side, etc.

Bets: Are wagers or stakes placed on a particular outcome or set of outcomes during a sporting event. Common types of bets offered by Ballers include (Bets are further defined under betting rules): Spread bets, Moneyline bets, Total bets (Over/Under), Parlays, Prop bets, Teasers, Reverse teasers, Round robin bets, Futures bets, Head-to-head bets, If bets. A bet can be open, meaning that the outcome of the event is still undecided or settled which means that the outcome of the event has been decided

Winnings: the amount of money a bettor receives from a successful bet, in addition to the original stake. This is determined by the odds that were given for the bet at the time it was placed. Winnings may be subject to taxes or other deductions. Players can generally withdrawn winnings once a bet has settled. For more details please refer to the payments, deposits and withdrawal sections of these terms and conditions 

Player Account: A registered account that a user (bettor) creates with Ballers Sportsbook and that is verified and approved by Ballers. The account is personal to the user and contains their personal information, betting history, transaction history, and current balance. The Ballers account allows the user to customize certain aspects of their account, such as communication preferences, deposit limits, and responsible gambling controls.

1. Registration:

In order to establish an account, you’ll be required to provide Ballers Sportsbook certain information including: Full Name and Last Name, Gender, Date of Birth, Nationality, Driver License or Passport Number, Email and Address. You will also be required to create a Username and Password and complete certain attestations. Once this information is required you’ll be asked to present valid id in person to a Ballers employee who will verify and validate the information you provided and approve or deny your account.

1. Eligibility:

You must be at least eighteen (18) years of age to open an account with Ballers Sportsbook ("Account"). You must be also physically located in the Commonwealth of Puerto Rico in order to open the account and participate in any online gaming and to place a wager or to win prizes offered by the Website. You consent to have Ballers Sportsbook confirm your age and identity.

You may establish only one (1) Account per person to participate in the Services offered on the Website. In the event Ballers discovers that you have opened more than one Account per person, in addition to any other rights that Ballers may have, Ballers reserves the right to suspend or terminate any or all of your Accounts and terminate, withhold or revoke the awarding of any winnings and prizes. You are responsible for maintaining the confidentiality of your login names and passwords and you accept responsibility for all activities, charges, and damages that occur under your Account. The method to change or retrieve your password is located at the FAQ section of the website. You can choose the strength of your authentication by following the process located under the "Account Management and Responsible Gaming" tab of the Website.

It shall be a violation of these Terms of Use to allow any other person to use your Account to participate in any Game. If you have reason to believe that someone is using your Account without your permission, you should contact us immediately. We will not be responsible for any loss or damage resulting from your failure to notify us of unauthorized use. If we request registration information from you, you must provide us with accurate and complete information and must update the information when it changes.

There are certain Federal prohibitions and restrictions regarding Internet gaming (i.e. 18 U.S.C. §§ 1084 et seq. (The Wire Act) and 31 U.S.C. §§5361 through 5367 (Unlawful Internet Gambling Enforcement Act)). It is a federal offense for persons physically located outside of Puerto Rico to engage in Internet wagering through a Puerto Rico operator. The availability of our Services does not constitute an offer, solicitation or invitation by us for the use of our Services outside the Commonwealth of Puerto Rico. Ballers shall not be liable for any breach of any local, national, federal, state or other laws that may occur as a result of your using the Services.

Your account may be deemed 'Dormant' if you have not logged in for a period of 12 months. If your account is deemed 'Dormant,' Ballers will close the account and any remaining funds will be considered abandoned and remitted.

"Authorized Account Holder" is defined as the natural person eighteen (18) years of age or older who is assigned to an e-mail address by an Internet access provider, online service provider, or other organization (e.g., business, education institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address for registration on the Website. By inputting a payment method to participate in Games, the Authorized Account Holder hereby affirms that the Authorized Account Holder is the lawful owner of the payment method account used to make any deposit(s) on the Website. It shall be a violation of these Terms of Use for any Authorized Account Holder to submit payment using any payment method that is not owned by the Authorized Account Holder.

In the event any of your deposits are charged back, any winnings, rewards, credits, and/or other bonuses or promotional offers generated in connection with the charged back deposit shall be invalidated, forfeited by you, and deducted from your Account balance. In the event that any deposit made by you is canceled or does not clear for any reason, including, without limitation, a charge back or not being honored by your financial institution, you agree to forfeit such deposit, and Ballers Sportsbook may and reserves the right to: (i) invalidate and/or deduct the deposit amount from your Account; (ii) charge you a service charge or debit such service charge from your Account; (iii) suspend and/or close your Account; and/or (iv) recover the funds using any other appropriate means, including, without limitation, utilizing a collection agency (that Ballers will need to share your personal information with), which may have a detrimental impact on your credit rating. You are responsible for and agree to reimburse Ballers for any and all reasonable claims, fees, fines, penalties, costs, and related expenses associated with any canceled or charged back deposits, including, without limitation, any fees or expenses related to a collection agency engaged by Ballers.

Ballers employees ("Employees") and Employees' Immediate Family Members (an "Immediate Family Member" means any domestic partner or relative who resides at the same residence, including without limitation, parents, grandparents, in-laws, children, siblings, and spouses) are not permitted to register or use the Services.

Other Prohibited Participants . Any individual whose participation may undermine the integrity of the wagering or the sports event or for other good cause, including but not limited to: (i) any individual placing a wager as an agent or proxy; (ii) any person who is an athlete, coach, referee, a player or a referee personnel member, in or on any sports event overseen by that person’s sports governing body; (iii) a person who holds a position of authority or influence sufficient to exert influence over the participants in a sporting contest, including but not limited to coaches, managers, handlers, athletic trainers, medical provider (iv) a person with access to certain types of exclusive information on any sports event overseen by that person’s sports governing body, or (v) a person identified by any of the excluson lists provided by the Comision de Juegos, shall not be permitted to wager on any event.

Ballers will take all measures to ensure that bets are only placed by users when physically present in Puerto Rico. You may not use a VPN, proxy or similar services or devices that mask or manipulate the identification of your real location.

In addition, conduct that would be deemed improper also includes, but is not limited to:

• Falsifying personal information required to enter a Game or claim a prize;
• Engaging in any type of financial fraud including unauthorized use of credit instruments to enter a Game or claim a prize;
• Colluding with any other individual(s) or engaging in any type of syndicate play;
• Any violation of Rules or the Terms of Use;
• Using a single Account to participate in a Game on behalf of multiple entrants or otherwise collaborating with others to participate in any Game;
• Using automated means (including without limitation harvesting bots, robots, parser, spiders or screen scrapers) to obtain, collect or access any information on the Website or of any User for any purpose.
• Any type of bonus abuse, abuse of the refer-a-friend program, or abuse of any other offers or promotions;
• Tampering with the administration of a Game or trying to in any way tamper with the computer programs or any security measure associated with a Game;
• Obtaining other entrants' information and spamming other entrants; or
• Abusing the Website in any way.

Users further acknowledge that the forfeiture and/or return of any prize shall in no way prevent Ballers from pursuing criminal or civil proceedings in connection with such conduct.

By entering into a Game or accepting any prize, entrants, including without limitation the winner(s), agree to indemnify, release and to hold harmless Ballers, its parents, subsidiaries, affiliates and agents, as well as the officers, directors, employees, shareholders and representatives of any of the foregoing entities (collectively, the "Released Parties"), its parents, subsidiaries, affiliates and divisions, and their respective directors, officers, employees, agents and representatives from any and all liability, claims or actions of any kind whatsoever, including without limitation injuries, damages, or losses to persons and property which may be sustained in connection with participation in the Game, the receipt, ownership, use or misuse of any prize or while preparing for, participating in and/or travelling to or from any prize related activity, as well as any claims based on publicity rights, defamation, or invasion of privacy. Ballers may, in its sole and absolute discretion, require an Authorized Account Holder to execute a separate release of claims similar to the one listed above in this Paragraph as a condition of being awarded any prize or receiving any payout.

Ballers is not responsible for: any incorrect, invalid or inaccurate entry information; human errors; postal delays/postage due mail; technical malfunctions; failures, including public utility or telephone outages; omissions, interruptions, deletions or defects of any telephone system or network, computer online systems, data, computer equipment, servers, providers, or software (including, without limitation software and operating systems that do not permit an entrant to participate in a Game), including without limitation any injury or damage to any entrant's or any other person's computer or video equipment relating to or resulting from participation in a Game; inability to access the Website, or any web pages that are part of or related to the Website; theft, tampering, destruction, or unauthorized access to, or alteration of, entries and/or images of any kind; data that is processed late or incorrectly or is incomplete or lost due to telephone, postal issues, computer or electronic malfunction or traffic congestion on telephone lines or transmission systems, or the Internet, or any service provider's facilities, or any phone site or website or for any other reason whatsoever; typographical, printing or other errors, or any combination thereof.

Ballers is not responsible for incomplete, illegible, misdirected or stolen entries. If for any reason a Game is not capable of running as originally planned, or if a Game, computer application, or website associated therewith (or any portion thereof) becomes corrupted or does not allow the proper entry to a Game in accordance with the Terms of Use or applicable Rules, or if infection by a computer (or similar) virus, bug, tampering, unauthorized intervention, actions by entrants, fraud, technical failures, or any other causes of any kind, in the sole opinion of Ballers corrupts or affects the administration, security, fairness, integrity, or proper conduct of a Game, the Company reserves the right, at its sole discretion, to disqualify any individual implicated in such action and/or to cancel, terminate, extend, modify or suspend the Game, and select the winner(s) from all eligible entries received. If such cancellation, termination, modification or suspension occurs, notification will be posted on the Website.

ANY ATTEMPT BY AN ENTRANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY DAMAGE THE WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF ANY GAME IS A VIOLATION OF CRIMINAL AND/OR CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, BALLERS RESERVES THE RIGHT TO SEEK DAMAGES AND OTHER REMEDIES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.

All entries become the property of Ballers and will not be acknowledged or returned.

To be eligible to enter any Game or receive any prize, the Authorized Account Holder may be required to provide Ballers with additional documentation and/or information to verify the identity of the Authorized Account Holder, and to provide proof that all eligibility requirements are met. In the event of a dispute as to the identity or eligibility of an Authorized Account Holder, Ballers will, in its sole and absolute discretion, utilize certain information collected by Ballers to assist in verifying the identity and/or eligibility of such Authorized Account Holder.

Participation in each Game must be made only as specified in the Terms of Use. Failure to comply with these Terms of Use will result in disqualification and, if applicable, prize forfeiture.

Where legal, both entrants and winners consent to the use of their name, voice, and likeness/photograph in and in connection with the development, production, distribution and/or exploitation of any Game or the Website. Winners agree that from the date of notification by Ballers of their status as a potential winner and continuing until such time when Ballers informs them that they no longer need to do so that they will make themselves available to Ballers for publicity, advertising, and promotion activities.

1. Account Security

At the time of registration for online account access, you must provide a valid email address and supply a Username and Password to be used in conjunction with your account. You may not use a Username that promotes a commercial venture or a Username that Ballers in its sole discretion deems offensive. Many portions of the Service require registration for access (the "Restricted Areas"). You are responsible for maintaining the confidentiality of Password, and are fully responsible for all uses of your Username and Password, whether by you or others. You agree to (a) never to use the same Password for the Service that you use or have ever used outside of the Service; (b) keep your Username and Password confidential and not share them with anyone else; (c) immediately notify Ballers of any unauthorized use of your Username and Password or account or any other breach of security; and (d) use only your own Username and Password to access the Service’s Restricted Areas. Ballers cannot and will not be liable for any loss or damage arising from your failure to comply with this Section.

You acknowledge and agree that Ballers is authorized to act on instructions received through the use of your Username and Password, and that ballers may, but is not obligated to, deny access or block any transaction made through use of your Username and Password without prior notice if we believe your Username and Password are being used by someone other than you, or for any other reason.

Ballers Sportsbook may require you to change your Username or may unilaterally change your Username.

1. Game Entry, Game Statistics, Game Results and Prizes

Entry: Registered and validated users will be able to visit the Website, log in, and view the sportsbook markets and events offered by Ballers and available to place a wager. When you select to participate in an event or events, select the bet amount, and complete the entry process, the listed amount of US dollars will be debited from your Ballers Sportsbook Account.

Statistics: To the extent that Ballers offers "live" statistics during gameplay, all "live" statistics and other information provided through the Website and related information sources are unofficial. Live sports statistics and their respective components are offered for informational and/or entertainment purposes only and are not used to determine the results of our Games. While Ballers and the third parties used to provide the Ballers Services use reasonable efforts to include accurate and up-to-date information, neither Ballers nor its third party providers warrant or make any representations of any kind with respect to the information provided through the Ballers Website and related information sources. Ballers and its third party providers shall not be responsible or liable for the accuracy, usefulness, or availability of any information transmitted or made available via the Website and related information sources, and shall not be responsible or liable for any error or omissions in that information.

Results: To the extent applicable, Game results and prize calculations are based on the final statistics and scoring results at the completion of the last sports game of each individual Game. Once Game results are reviewed and graded, prizes are awarded. The scoring results of a Game will not be changed regardless of any official statistics or scoring adjustments made by the leagues at later times or dates, except in Ballers' sole and absolute discretion.

Ballers reserves the right, in its sole and absolute discretion, to deny any customer or participant the ability to participate in Games for any reason whatsoever. Further, Ballers may, in its sole and absolute discretion, invalidate any head-to-head Game result for the purposes of preventing abusive and/or any unfair or potentially unlawful activity, or in the event that there is a risk of any such abusive, illegal, or unfair activity.

In the event of any malfunction, all pays are void.

Prizes: Subject to the Company verifying your compliance with the Terms, Rules and other conditions of participation, at the conclusion of each Game, Ballers shall use commercially reasonable efforts to award the winnings and/or prizes within a reasonable amount of time.

1. Deposits and Withdrawals

By establishing your account and depositing funds, you agree to provide us with a valid mailing address, date of birth and social security number and any other information Ballers may require in order to run appropriate identity checks and comply with applicable federal and state rules and regulations. Deposits into an Account can be made by means provided on the website. Ballers may limit the amount a User can deposit into their account in accordance with government-imposed limits, risk management and Ballers own discretion. Ballers Sportsbook accepts various forms of payment for deposits, such as cash, credit cards, ATH and ATH Mobile. Deposits made through the ATH Mobile Application between 11:00 a.m. and 7:00 p.m. from Monday to Saturday, as well as on Sundays between 11:00 a.m. and 5:00 p.m., will be processed and assigned to the customer's account the same day. However, those deposits made after 7:00 p.m. Monday through Saturday or after 5:00 p.m. Sundays will be assigned to the customer's account the next day. It is important to note that the minimum amount allowed to make a deposit through ATH Móvil is $20.00.

To make a deposit through ATH Móvil, the client must use the ATH Móvil account associated with the same phone number registered in the Ballers system. In addition, it is requested to include the username in the comments area to facilitate customer identification.

Deposits and User winnings are held in a separate, segregated bank account. These funds belong to you, subject to review of evidence of fraud, and Ballers may not use these funds to cover operating expenses or for any other purposes. Your withdrawals will be made from this separate bank account.

Ballers is required to comply with all state and federal tax reporting requirements and as such, may request winning users to provide updated User Data for tax reporting purposes. You are responsible for filing and paying all applicable state and federal taxes on any winnings. Ballers does not provide any tax advice, nor should any provisions in these Rules or on the Service be construed as tax advice.

Ballers reserves the right to remove or add payment options from time to time. Current available payment methods can be viewed within the 'My Account' section of our website when you are logged in to your Account. We reserve the right to process withdrawals back to the payment method(s) used to make your deposit by refunding the original deposits, up to the total amount deposited, before allowing other withdrawal options.

If Ballers determines that funds deposited are not for the purpose of betting, Ballers may in its discretion decline the deposit, return the funds to the original payment method used to fund the Account, and close the User's Account.

If Ballers determines that the funds deposited are not from a funding instrument in the User's name or are not expressly authorized to be used by them, Ballers reserves the right to decline the deposit and return the funds to the original payment method. If this determination takes place after bets have been placed, Ballers reserves the right to void any resulted or pending bets on the User's Account.

If Ballers determines that there is not enough information to prove the owner of a particular payment option, we reserve the right to request certified documentation as proof of ownership prior to making any decision.

Ballers reserves the right to check directly with the Users's funding institution that supplied the payment option used to deposit to confirm that the details provided by the User to Ballers are valid and correct.

A User may be restricted in stake while placing a bet, if an error is made during a transaction, or for any other reason, determined at our discretion. Any malfunction on the website will void your play.

By depositing to Ballers you accept that at its discretion, Ballers may require a user to return the value of their deposit back to the original funding instrument.

Ballers must comply with the Bank Secrecy Act of 1970. Should we consider that a deposit or withdrawal may potentially be fraudulent, we reserve the right to request proof of deposit or withdrawal bank account information to verify that the information provided is true and correct prior to permitting funds to be withdrawn from the Account.

If Ballers determines that the risk presented from a payment to or from an Account to be undesirable, Ballers reserves the right to cancel the deposit or withdrawal.

Ballers may charge User fees for credit card deposit or withdrawal fees.

Ballers reserves the right to pass on any transaction processing fees to Users for deposits or withdrawals that we determine are independent of Ballers.

Ballers does not allow third party bank account holders or Credit card holders to transact on an Account that has not been registered in their name. User's must use their own or joint deposit and withdrawal methods. Ballers reserve the right to suspend any Accounts, without notice, with third party payment details and will request confirmation of permitted use from that third party prior to re-opening the applicable Account and allowing further transactions.

If Ballers successfully identifies third party payment transactions on an Account, we reserve the right to remedy the situation. In this case, Users accept that any bets placed, or still pending, may be voided and funds returned to them. Users accept that Ballers will review each situation on a case-by-case basis taking into account deposits, withdrawals, bets and any other information available. Users accept that when an Account has not been operated on a good faith basis that Ballers may refuse future transactions and retrospectively void existing ones, at its discretion.

Ballers reserves the right to place limits on deposits and restrict or prohibit withdrawals on any User's Account if the User has not fulfilled the identification requirements specified herein, and if required, suspend a user account entirely until those requirements have been satisfied.

Ballers, at its own discretion, reserves the right to process withdrawals up to (or equal to) the original deposited amount back to a credit card used to deposit by the user.

Ballers reserves the right to reject pending withdrawals to ensure that the maximum loss of all pending bets do not result in a negative account balance.

You have the right to review all your gaming activity under "Transaction History" which details a User's deposit, withdrawal, and betting activity, and Responsible Gambling limits.

Ballers has a number of controls and checks in place during the withdrawal process. In order to protect your funds, Balers implements a number of security checks before any withdrawal request is processed. Ballers reserves the right to withhold any withdrawal until these checks have been completed. There may be some delays if a withdrawal is requested outside of business hours. We generally expect withdrawals to be processed within twenty-four (48) hours, however they may take up to five (5) working days.

1. Ballers Rights and other matters

Balllers reserves the right to cancel, change or restrict the products or bet types at any time with or without notice to Users.

Ballers reserves the right to remove bonuses and refund the remaining balance should a user be in breach of these Rules and/or the terms and conditions of the specific promotion.

Ballers products and bet types are intended for bona fide users, that is, those users who act in good faith, sincerely, without fraud, and who place a bet with Ballers for the purpose of recreation and entertainment.

Ballers reserves the right, in its sole discretion, to determine that a user is not eligible for certain products, bet types or promotions.

Ballers reserves the right to close or suspend the Accounts of, and void any or all bets made by any person where, in Ballers's reasonable opinion, the Account has not been operated with integrity and/or the bet has not been placed on a good faith basis. This includes, but is not limited to, situations where an account is being used by someone other than the account holder. Ballers can, in its sole discretion, withhold any or all related funds in the Account pending the outcome of an investigation on that Account.

Where a user has been referred to Ballers by a third party, you acknowledge that Ballers may make commission payments to that third party. These payments are unrelated to the odds or prize money offered to users by Ballers.

As a responsible bookmaker, Ballers offers its users the ability to control the amount they deposit by setting a limit on the amount they can deposit to their Account

Any reference to a discretion which may be exercised by Ballers under these Rules means Ballers’ sole and absolute discretion.

1. Information provided to governing bodies

Ballers reserves the right to provide the relevant gaming regulatory body in the state in which your account was registered, with: records or documents in the possession or control of Ballers relating to betting transactions of the user; and the name, contact details and similar identifying information in the possession or control of Ballers relating to that user. Such information will only be provided to assist in a legitimate inquiry conducted by the Comision de Juegos. For the avoidance of doubt, the Userconsents to Ballers providing the above information to the Comision de juegos.

In addition, you agree that any User Submissions you submit shall not contain any material that is, in Ballers' sole and absolute discretion, inappropriate, obscene, vulgar, unlawful, or otherwise objectionable (hereinafter, "Prohibited Content"). Posting of any Prohibited Content, in addition to any and all other rights and remedies available to Ballers, may result in account suspension or termination.

We may refuse or remove a User Submission without notice to you. However, Ballers has no obligation to monitor User Submissions, and you agree that neither the Company nor its parents, subsidiaries, affiliates, employees, or agents will be liable for User Submissions or any loss or damage resulting from User Submissions.

Except as provided in the Privacy Notice, Ballers does not guarantee that User Submissions will be private, even if the User Submission is in a password-protected area. Accordingly, you should not provide User Submissions that you want protected from others.

You represent and warrant that you have all rights necessary to grant to Ballers the license above and that none of your User Submissions are defamatory, violate any rights of third parties (including intellectual property rights or rights of publicity or privacy), or violate applicable law.

1. Complaints Dispute resolution

If a registered player has a complaint or grievance about the outcome of a bet, the balance of their account, or any other aspect of the operation of Ballers Sportsbook's Sports Betting, the player may submit it to Ballers 24 hours a day, 7 days a week.

The player may submit a complaint in three ways: by personally visiting one of Ballers' authorized locations, via email at [email protected], or through phone or WhatsApp using the customer service phone numbers advertised on the website at www.ballerspr.com (787-803-7777 and 787-803-7529).

Responses to Complaints: Ballers will use the available communication channels provided as part of the player complaint procedure to respond to any claims or complaints submitted by a player.

Ballers will respond to such complaints in writing within ten business days. If the requested remedy is not granted in response to the complaint, the reasons for this will be specified in the response.

Complaints Requiring Additional Information: If the response to a complaint is that more information is needed, the specific type and nature of the required information will be indicated. Once the required additional information is received, Ballers will issue a new response within seven days.

Retention of Complaints by Ballers: All complaints received by Ballers from a player and Ballers' responses to the complaints will be retained for at least five years.

Player's Authority to Approach the Puerto Rico Gaming Commission:  As stipulated in Regulation 9316 of Sports Betting in Puerto Rico, if a player is not satisfied or in agreement with the options and/or remedies provided by Ballers to resolve a claim or complaint, they may approach the Puerto Rico Gaming Commission with the purpose of mediating and potentially reaching a resolution regarding the matter. 1. Miscellaneous:

Termination: You may close your account and withdraw your deposits and/or winnings at any time and for any reason. Account closing will be done through the Ballers customer service department and shall follow the Terms described in this section.

Dormant Accounts: Your account may be deemed 'Dormant' if you have not logged in for a period of 12 months. If your account is deemed 'Dormant,' Ballers will close the account and any remaining funds will be considered abandoned and remitted in accordance with local regulations.

Jurisdiction: These Terms of Use shall be governed by the internal substantive laws of the Commonwealth of Puerto Rico, without respect to its conflict of laws principles or any other law or regulation that would permit or require the application of the substantive laws of any jurisdiction other than the Commonwealth of Puerto Rico. Any claim or dispute between you and Ballers that arises in whole or in part from the Terms of Use, the Website or any Contest shall be decided exclusively by a court of competent jurisdiction located in the Commonwealth of Puerto Rico.

Modification of these Terms and Conditions: Ballers reserves the right to amend these Terms of Use at any time and without notice, and it is your responsibility to review these Terms of Use for any changes. If you continue to use the Services after the Company amends these Terms of Use, you accept all changes. The failure of Ballers to comply with any provision of these Terms of Use due to an act of God, hurricane, war, fire, riot, earthquake, terrorism, act of public enemies, actions of governmental authorities outside of the control of the Company (excepting compliance with applicable codes and regulations) or other force majeure event will not be considered a breach of these Terms of Use.
